Terms and Conditions

1. General 

1.1. Any use of the Hermes Casino (the “Website”) and the information, materials and links contained in the Website, should be done solely in accordance with the terms and conditions set out below, hereinafter referred to as the “Terms and Conditions” or “T&C”, which constitute the entire agreement between the each user of the Website (the “User”) and Hermes Casino for the use of the Website.

1.2. These Terms & Conditions shall immediately become effective as from the date when the User registers on the Website by providing his/her details with Hermes Casino. These Terms & Conditions shall be the official source of reference for any dispute related to the use of the Website, service or software used through the Website. 1.3. Hermes Casino may amend these Terms and Conditions. However, if the Terms and Conditions are amended, the Company shall notify each User prior to such changes taking effect and the User shall be required to re-confirm their acceptance. If a User does not agree to the updated Terms and Conditions, Hermes Casino reserves the right to require the termination of the User’s account and use of the Website. The Terms and Conditions may be the subject of such amendments due to regulatory requirements imposed on Hermes Casino, and in such case, any change of the Terms and Conditions may not require the User approval and Hermes Casino shall be obligated only to notify the User of the said change made to the Terms and Conditions.

1.4. Headings are intended for clarity and to facilitate reading of the Terms and Conditions. They are not intended as a means of interpretation for the content of the paragraph that follows each heading. Headings are not intended to bind Hermes Casino in any manner whatsoever.

1.5. Any waiver by Hermes Casino of any breach by any User of any of the provision of the Terms and Conditions shall not be considered as a waiver to any right arising out of a subsequent breach of the same or any other provision of the Terms and Conditions.

1.6. References in these Terms and Conditions to “Game” or “Games” are made with regards to any gaming activity presented by Hermes Casino on its Website for the benefit of the Users and approved by the Competent Authority, if required.

1.7. The User must read the Terms and Conditions before making use of this Website. The use of Website and/or opening of an account with Hermes Casino is an acknowledgement that the User has read, understood and agrees to be bound by the Terms and Conditions. Should there be any discrepancy between the Terms and Conditions in the English language version and the version in any other language, the English version shall take precedence. 2. Your member account

2.1. Hermes Casino shall not permit, by the means available at its disposal, a person to participate as a User in an authorised Game provided by Hermes Casino unless it is registered as a Customer and holds an Account with Hermes Casino. The User opens an Account by completing the online registering application, which is an integral part of the Website. To verify the User’s identity, Hermes Casino reserves the right to request at any time satisfactory proof of identity (such as, but not limited to, copy of ID, passport or any payment cards used) and proof of address (recent utility bill or bank statement). Failure to supply such documentation may result in suspension of the account. All documentation must be submitted to support@casinohermes.com and once approved shall be considered valid for 6 months. It is the User sole responsibility to provide updated copies of the necessary documents once the validity period expires. The registration and the set-up of the Account is free of charge.

2.1.1 Hermes Casino has the right to demand any further information from the User, as it may deem appropriate, such as proof of identity, ownership of payment methods used, proof of address, or proof of source of funds. If the customer fails to comply, or if any irregularities are found upon review, Hermes Casino will immediately report the matter to the Competent Authorities and may suspend the User Account and any: wagering, betting and payout requests alongside retracting any bonuses and winnings attributed to the User’s Account and/or unilaterally terminating the account by refunding the deposited amounts to the User, after deduction of costs incurred by Hermes Casino due to the User’s activity.

2.1.2. The User must fill in the application form provided by Hermes Casino which shall satisfy the following requirements:

(i) that the User satisfies the age requirements for participating in online gambling activities imposed in his country;

(ii) the User’s identity (accompanied by proof of identity such as identity card, passport copy or driving license);

(iii) the User’s place of residence (accompanied by proof of customer’s residence such as a utility bill);

(iv) the User’s valid email or phone number;

(v) the User shall warrant and represent that he isn’t accessing the Website or is a resident form the Restricted Territory.

(vi) the User participates in the Games only in its name and only for entertainment purposes;

(vii) the User is solely responsible and liable for reporting any taxes applicable to you for any winnings recorded;

(viii) the amounts the User deposits into the Account have not been procured by means that may be deemed as illegal;

(ix) the User wasn’t involved in any fraudulent or unlawful activity in relation to Hermes Casino or third parties’ participation in any of the Games;

(x) the User shall be courteous in the relation with other Users and shall avoid rude or obscene comments or other such interactions;

 

2.1.3. If Hermes Casino becomes aware that a User has provided false information in this respect, Hermes Casino shall not register such User and where that User has already been registered, Hermes Casino shall immediately cancel that User’s Account from the Hermes Casino. The User also agrees to update any information mentioned in Section 2.1.2 above should there be any changes to the information provided previously to Hermes Casino.

2.1.4. By opening an account with Hermes Casino, the User implicitly gives his authorisation to the processing of any personal data in compliance with the Applicable Legislation.

2.1.5. Hermes Casino shall not make any payout from a User’s Account until the user’s identity, age and place of residence have been verified using the means available at its disposal, by Hermes Casino.

2.1.6. Hermes Casino, at all times reserves the right to carry out verification procedures, whether itself or through third parties on depositing Users and may request additional documents at any stage, as part of its KYC procedures. Hermes Casino may also request any documentation previously provided which would have expired or would no longer be valid for any reason, or to request any additional documentation for any reason and at any time. Failure to provide these documents or false or misleading information may result in a User’s Account being permanently blocked and withhold of any funds held in the User’s Account until the verification process is complete.

2.1.7. To be able to use the Games, a deposit account must be opened. Upon opening an account, the User shall be assigned a login (username) and password that are required to access the Account

2.1.8. Hermes Casino reserves the right to deny or retract, for whatever reason deemed necessary by Hermes Casino, any or all User screen names and/or User Names, whether before, during and after these names have been issued or validated

2.1.9. It is the User's responsibility to keep data such as login {username} and password confidential. Hermes Casino cannot be held responsible of any misuse of User‘s credentials, provided that Hermes Casino has been correctly supplied with the Account information requested, we are entitled to assume that orders, payments and instructions are made by the Customer.

2.1.10. Hermes Casino is in no way responsible if the User forgets, misplaces, or loses his/her password, except as a result of an error on the part of Hermes Casino. Hermes Casino shall not be responsible to store passwords, Usernames and Logins of the User. Hermes Casino shall not be responsible in any way for the eventual access to a User’s account by a third person and will not be held responsible for any eventual loss suffered due to the illicit use of a User’s password by a third person, of unauthorized access, and/or for any transaction in which the name and password of a User was registered correctly.

2.1.11. A Game online under User’s Username and security details will be regarded as valid, irrespective of who actually participates in the Game under the respective Username and security details. In the event the Customer is concerned about the confidentiality of its Username and security details, it shall notify Hermes Casino immediately whereupon new details may be forwarded to it and any future transactions under the previous Username and security details shall be considered void.

2.1.12. If the Account Holder does not access the Account by “logging in” using his Account name and security details for a consecutive period of six calendar months, his account shall be deemed to be “Inactive”. Hermes Casino shall be entitled to charge an administrative fee of € 5.00 charged at the end of each calendar month that the Account remains Inactive and may deduct the same from Account Balance. The administration fee will no longer be charged if the User’s Account is re-activated prior to any monthly fee being deducted. Hermes Casino will alert every User inactive for 5 months about the possible upcoming administration fee by sending an alert message on the User’s email.

2.1.13. Each User is allowed to open only one account. Use of more than one account per physical User is known as “multi-accounting”, which is strictly prohibited. Upon discovery of a User with multiple account, all affiliated accounts of the User will be immediately cancelled including the cancellation of any transactions of the multiple accounts. In the event that Hermes Casino has reasonable reasons to suspect that the registration of said multiple Accounts has been undertaken with the intent of defrauding or cheating, Hermes Casino may block regular or tournament play and/or prize distribution. Such events shall be officially treated as collusion according to Article 2.36 and 2.37 of these Terms & Conditions.

2.1.14. Hermes Casino does not allow different Account holders from the same household and/or family play on the same bet. The meaning of the term “Same Bet” in this clause includes different combinations of the same bet. Should a User breach the aforementioned prohibition, Hermes Casino reserves the right to cancel such bet subject to the rules of cancellation stated herein.

2.1.15. Users may only use their own credit / debit card in their own account. Any deposits made using another individual’s credit / debit card will be refunded and any games played or winnings made with funds from such card will be deemed void. All the purchases made in Games by the User are subject to instant consumption when playing. Thus, the Company cannot provide return of the purchases made, refunds or cancellation.

2.2. Deposits

2.2.1. Hermes Casino shall not accept cash from any User. Only payments made in the support currencies are acceptable. Any potential exchange premiums or charges are payable by the User. For the avoidance of doubt any funds may be received from the User only using any of the following methods: credit cards, debit cards, electronic transfers/wallets/vouchers, and wire transfers.

2.2.2. All payments to and from the User’s Account must be paid in the currencies available on the Website and all payments into User’s Account must be from a payment source on which User is the named account holder.

2.2.3. Funds deposited must be utilised for the placing of bets/stakes in the Games and any suspicious activity or betting irregularities on a User’s Account may lead Hermes Casino to report the respective User to the Competent Authority, freeze the funds or even close the Account.

2.2.4. In the event of misuse and/or the abuse of promotions and/or of any offers from Hermes Casino, Hermes Casino reserves the right to close, void any winnings and block the accounts of the client in question until the matter between Hermes Casino and the client is resolved.

2.2.5. The Amounts deposited into Hermes Casino shall be available for use in the User’s Account within twenty-four hours from receipt of the respective amount. The twenty-four hour time frame specifically excludes the timeframe that the bank, or the payment solutions entity has offered by Hermes Casino undertake to process the transfer of the amounts. Hermes Casino cannot provide returns of goods, refunds or cancellation of service when playing. If you play a Game with real money, the money will be drawn from Your Member Account instantly.

2.2.6. Hermes Casino reserves the right to set a maximum amount of funds that can be deposited with Hermes Casino per transaction. Such maximum can be varied at Hermes Casino’s discretion.

2.2.7. It is forbidden for a User to transfer money from one member account to another or to sell, transfer, and/or acquire funds to/from other Users.

2.2.8. Hermes Casino reserves the right to take any measures and adopt any procedures to obtain the verification of information provided by the User. If such evidence is not obtained, or where Hermes Casino knows or suspects that the transaction may be related to money laundering or the funding of terrorism, Hermes Casino shall not proceed with such transaction and shall have the right to close such User’s account and shall have the right to disclose details of such transaction to the Competent Authorities.

2.2.9. User shall not treat the Company as a financial institution. The Company reserves the right to restrict withdrawals of funds not used for wagering/bets and investigate the withdrawal requests with the relevant Authorities.

2.3 No Interest

2.3.1. All payments to and from the User’s Account must be paid in the currencies available on the Website from time to time and shall not bear interest. All payments into the User’s Account must be from a payment source on which you are the named account holder.

2.3.2. Notwithstanding the above, Hermes Casino warrants and represents that, should any interest be payable to a User’s account, it shall be credited only to the respective account.

2.3.3. All Users’ funds are kept in separate bank accounts from the funds of Hermes Casino with a licensed credit institution and are protected from third parties’ claims even in the event of insolvency of Hermes Casino. The licensed credit institution with which the Users’ funds are kept is aware that the funds are Users’ funds and will not attempt to enforce or execute any charge, write-off, set-off or other claim against the Users’ funds bank accounts, and will not combine the Users’ funds bank accounts with any other bank account in respect of any debt owed by Hermes Casino.

(i) In cases where the User deposits money with Hermes Casino by bank transfer or through other payment solutions offered by Hermes Casino, the User may record more than one bank account with Hermes Casino. Upon receipt of such a request, Hermes Casino shall confirm that the User is the actual Account Holder. In this regard Hermes Casino reserves the right to request all documentation necessary, including a bank statement, to confirm that bank accounts belong to the respective User. Users who have recorded more than one bank account may request that the pay-out is made by transfer to any bank account recorded with and verified by Hermes Casino.

(ii) In cases where the payment solutions provided by Hermes Casino does not offer redirection of pay-outs to the same bank account from which the funds originated, the User shall record a bank account with Hermes Casino. Pay-outs in such cases shall be made by bank transfer to the bank account as recorded and verified by Hermes Casino, or via an e-wallet solution, chosen by the User at its sole and absolute discretion (provided that no territory restrictions or other restrictions should apply.

 

2.4. Withdrawal Requests

2.4.1. The User may at any time request a pay-out from the existing balance of his/her User Account in whole or in part provided that all payments have been confirmed, all amounts have been deposited, wagering requirements have been met and all mandatory documentation has been approved by the Company. We shall honor one payout approval per account, per review and per week. If you submitted more withdrawal requests simultaneously, only one of the submissions shall be subject to review.

2.4.2. Withdrawal requests shall be processed from Monday to Friday, within 72 hours from the moment the User has placed a withdrawal request on its Account. Please note that management may determine more or less weekly payout limits depending on your VIP status. Once approved, a withdrawal request will be finalized depending on the User preferred payment option. 2.4.2.1 Players who withdraw a sum of money that is 5 times or more, greater than their lifetime deposits across the Casino Group will liable for detailed game and play review. The remaining amount will be placed back in the player's account until such time that they are eligible for a further withdrawal.

2.4.3. The User may withdraw any amounts from the User Account only after it submits images of both sides of the credit card or any other documents required by the Hermes Casino.

2.4.5. Withdrawals from a User’s Account may only be addressed strictly to the person registered on the Account and as per the conditions specified on the Hermes Casino Website.

2.4.6. Should funds be credited to a User’s Account in error, it is the User’s responsibility to notify Hermes Casino about the error without delay. Any winnings subsequent to the error and prior to the notification of Hermes Casino provided they are linked to such error, shall be deemed invalid and returned to Hermes Casino.

2.4.7. Hermes Casino cannot be held liable for changes to a User’s Account balance due to a Third Party playing and using that User’s nickname, username or password.

2.4.8. Hermes Casino reserves the right to request, at any time, confirmation of its User’s bank account numbers or proof of payment to Users’ accounts for all alternative payments Hermes Casino

2.4.9 Hermes Casino reserve the right to choose Accounts with pending payouts randomly for an additional verification process. The process includes but is not limited to a review and authentication of the paperwork provided by the User; verification that Account information matches the documents on file; and a thorough review of the Game sessions. This procedure can be performed up to twice per year and depends significantly on the security level set by Hermes Casino’s Risk and Security Department.

2.5. Marketing and Promotion

2.5.1. In the event that a User wins an amount equal to €3,000.00 [three thousand EURO] or higher, through the use of the Software or the Service, the User agrees to give the Company the exclusive, worldwide, permanent and irrevocable right and authorization to use the User’s name, photograph, and portrait in all media as part of the Company’s marketing and promotional needs, and for its Website(s), and to be fully cooperative with Hermes Casino representatives including support staff.

2.5.2. Bonus credits can be placed into a Users’ account as part of a marketing campaign. These credits cannot be withdrawn or paid out but they must be used for the placing of bets in the manner stated in the respective rules of different marketing bonus campaigns.

2.5.6. Hermes Casino will have the right to withhold or otherwise decline or reverse any pay-out or winning amount or amend any policy in the event that there is a reasonable suspicion that a User is abusing or attempting to abuse any of the following: (i) bonuses; (ii) other promotions; or (iii) specific policy or rules determined in respect of an existing Game or a new Game. 2.6. Closing of Accounts

2.6.1. Any Account Holder is entitled to close his Account and terminate this Agreement at any time by sending an email to Hermes Casino using these details: support@casinohermes.com and Hermes Casino will respond within a reasonable time. Provided that the Account Holder shall be responsible for activity on his Account until such closure has been effected by Hermes Casino. Hermes Casino is entitled to terminate this Agreement immediately on notice (or attempted notice) to the Account Holder at the email address that was provided to the Company. Where the Company has terminated a User’s Account as a result of a failed Security Review, any Account Balances in the User’s Account are non-refundable and deemed forfeited.

2.6.2. In the event of termination of the User’s User Account, a User shall be permitted to withdraw any balances after deduction of withdrawal fees and bonus balances

2.6.3. All payments shall be remitted to the User within 5-15 business days following the User’s request.

2.6.4. No employees, managers, directors, consultants, agents, branches or affiliated companies, any of the providers or sellers of Hermes Casino nor their relatives (in this clause, the term « relatives » means spouse, partner, parents, children or siblings of the people mentioned above) can participate in any games during their term of employment, management, directorship, engagement or contractual relationship with Hermes Casino. In no case any officers, directors, employees, consultants or any other persons conducting business or engaged with Hermes Casino shall be allowed to open an Account with Hermes Casino during the term of their engagement. If this provision shall be breached Hermes Casino shall take any measure it considers necessary in respect of the agreement existing between the respective employee, etc. and Hermes Casino.

2.6.5. No Hermes Casino executives, nor their relatives (in this clause, the term « relatives » means spouse, partner, parents, children or siblings of the people mentioned above) are allowed to play on the Website or are authorised to use the Services directly or indirectly. Nevertheless, this provision shall not apply where relatives are expressly allowed to play on the Hermes Casino Website by means of written authorisation by Hermes Casino. Hermes Casino employees, or anyone else having access to inside information (for example: complete hand histories, playing histories, money transaction histories, and similar) are not allowed to use the services of the Website. The objective of this clause is to prevent any potential abuse of inside information.

2.6.6. If clauses 2.6.4. and 2.6.5. are breached, Hermes Casino reserves the right to close the said Account immediately and to cancel the payment on any amounts that were gained. This procedure shall take place without any prejudice to the rights that Hermes Casino has against the breaching User in respect with the Agreement.

2.7. User’s Insolvency

2.7.1. Hermes Casino reserves the right to verify the financial solvency of any of the User, through the information furnished during registration and through Third Parties. In the event that such User’s insolvency is verified, then Hermes Casino shall have the right to terminate/close down the account and prohibit the User from opening another account at Hermes Casino or any of its corporate affiliates.

 

3. Your obligations as a User 

3.1. You hereby represent and warrant that:

You are over 18 years old or such higher minimum legal age as stipulated in the laws of jurisdiction applicable to You and, under the laws applicable to You, You are allowed to participate in the Games offered on the Website. It is the Users’ responsibility to know whether the processing and opening of Hermes Casino Account is allowed within their jurisdiction. It is of note that underage gambling is an offence.

3.3. You fully understand that it is entirely and solely Your responsibility to enquire and ensure that You do not breach laws applicable to You by participating in the Games;

You are and shall not be involved in any fraudulent, collusive, fixing or other unlawful activity in relation to Your or third parties’ participation in any of the Games and shall not use any software-assisted methods or techniques or hardware devices in connection with for Your participation in any of the Games. Hermes Casino hereby reserves the right to invalidate or close Your Member Account or invalidate or terminate Your participation in a Game in the event of such behavior.

3.8. In relation to deposits and withdrawals of funds into and from Your Member Account, You shall only use funds, credit card and other financial instruments that are valid and lawfully belong to You.

3.9. The computer software that we make available to You is owned by Hermes Casino or other third parties and protected by copyright and other intellectual property rights. You may only use the software for Your own personal, recreational use in accordance with all rules, terms and conditions as set out in these T&C and in accordance with all applicable laws, rules and regulations.

3.11 You must have all required documents on file before requesting a payout. 4. Responsible gaming

4.5. A User who has set a limit or exclusion may change or revoke the limit or exclusion by written notice or electronic notice given to Hermes Casino. The minimum period of exclusion shall be 6 months. During the self-exclusion period Hermes Casino will take all reasonable steps to ensure that a User who set exclusion will not receive any marketing material. The Users’ details will be removed from the marketing database within 2 days from when the self-exclusion shall become applicable. Once a self-exclusion is set, the User can withdraw all funds from the Account.

4.6. A notice increasing or revoking a limit or decreasing the exclusion has effect only after seven (7) days after Hermes Casino has received the notice.

4.7. A notice reducing a limit or increasing the exclusion has effect immediately after it is received by Hermes Casino.

4.8. Hermes Casino shall not accept a wager from a User contrary to a limit or exclusion set by the User under this regulation.

4.9. For a self-excluded User to be able to re-open his Account, he must contact User support to re-open the Account, as otherwise the self-exclusion shall remain in place. Once a request for re-opening of the account takes place, the Account shall be opened after the lapse of 1 day cooling off period.

4.10. Hermes Casino hereby ensures the security of all financial information on the Users and financial documents whether relating in/directly to the transactions affected between the Users and Hermes Casino or between Hermes Casino and the Competent Authorities.

4.11. Hermes Casino shall, at all times, keep a secure list of all registered Users and shall ensure the reasonable security of all User Accounts by backing up the database containing this information.

4.12. Hermes Casino may process any personal data of the Users in accordance with applicable data protection laws including, but not limited to, processing User’s Account and payments, keeping records and verifying identity and fraud investigation.

4.13. Hermes Casino may share User’s personal data with any of its financial agents who may only use it for those purposes defined by Hermes Casino, or as otherwise permitted by the Applicable Legislation.

4.14. Unless the User has indicated otherwise, Hermes Casino may contact any User with product and service related information, such as direct email newspapers and/or any other special marketing and/or advertising offers.

4.15. The User consents to the recording of all Website use, electronic mails and telephone calls between the User and Hermes Casino. These recordings shall be the sole property of the Company and may be used as evidence in the event of any dispute or to improve User services.

 

5. Hermes Casino VIP club

5.1. Hermes Casino reserves the right to change the terms and conditions and rules for the Rewards Program at any time, e.g., change the parameters for calculations of points. If Hermes Casino suspects that You are engaged in illegal or fraudulent activities when using the Rewards and VIP Program or in breach with these Terms and Conditions, Hermes Casino may freeze or terminate Your Member Account and/or a related account (e.g. a referred friend) at Hermes Casino's absolute discretion.

7. Complaints

7.2. Should the Customer not be satisfied with the resolution of such complaint by Hermes Casino, a further complaint may be addressed to the Competent Authorities, which acts as an independent alternative dispute resolution entity, by contacting them at support@casinohermes.com.

7.3. Hermes Casino is in no way responsible for the investigation or the initiation of a Complaint made by a User against another User for any reason, including but not limited to, the conditions in this Agreement. Hermes Casino in its sole and absolute discretion may decide to act against any User suspected of illicit actions or of wanting to violate the conditions of this Agreement.

7.4. Any complaint, demand, inquiry or request (the “Complaint”) made by a User regarding any reason that may arise from the usage of the Services and Software shall be registered at Company, by any of the available means, in a timeframe that may not exceed seven (7) days from the completion of the respective transaction, incident or event (the “Incident”) that generated the Complaint. If the User doesn’t register the Complaint in the above mentioned timeframe, the Complaint shall not be taken into consideration.

8. Disclaimer & limitation of liability 

8.1. Hermes Casino shall in no event, nor under any circumstances, be liable for any damages or losses that are deemed or alleged to have resulted from or caused by the Website or its content, including, without limitation, delays or interruptions in operation or transmission, communications lines failure, any User’s use or misuse of the Website or its Content, or any errors or omissions in content.

In case of a litigation between the internet provider and the User, Hermes Casino cannot be a party to the lawsuit, and such lawsuit shall in no way affect the User’s obligations under this Agreement.

8.11. In the event that Hermes Casino is found liable in any way, by a court of law and/or a similar authority, with legal competence and/or jurisdiction over Hermes Casino, then Hermes Casino’s liability is limited to the amount of the wagers placed via the User’s Account on the Website in respect of the wager that gave rise to the relevant liability. Alternatively, when relevant and applicable, the amount recorded in the Hermes Casino Account or the amount transferred into or out of the Hermes Casino Account, whichever is the lesser.

8.12. The User warrants and represents it has chosen and used the Services and the Software willingly, at its sole and absolute discretion and at his own risk.

8.15. Hermes Casino is in no way liable or responsible for any, included but not limited to loss of profit or damage that a User or a Third Party might have suffered as a result to any modification, suspension or interruption of the Services or of the Software.

8.16. Hermes Casino is in no way liable or responsible for any loss or damage, including but not limited to a loss of profit, as a result of improper functioning of the Services or the Software, any delay, interruption, transmission, loss or corruption of data, improper functioning of the means of communication, criminal use of the Website or of its content by any person, of a defect, or omission or of any other factor beyond Hermes Casino’s control. In the event that the malfunction results in any profit, whether collected or credited to the User’s Account, Hermes Casino reserves the right to claim all gains that the User may have benefited from as a result of one of those malfunctions, and the User would be obliged to immediately reimburse Hermes Casino the amount collected and to inform Hermes Casino of the malfunction. 9. Anti-money laundering reporting 

9.1. If You become aware of any suspicious activity relating to any of the Games on the Website, You must report this to Hermes Casino immediately.

9.2. Hermes Casino may suspend, block or close a User’s Account and withhold funds if suspicions of money laundering occur in accordance with any applicable Prevention of Money Laundering Act.

 

10. Breach of contract penalties and termination

10.1. In accepting the terms of this Agreement , the User is bound to integrally indemnify Hermes Casino, to defend Hermes Casino and to exonerate Hermes Casino, on demand of any complaint, liability, damage, loss, cost or expense, including but not limited to all legal fees or others that we shall bear as a result of breach of this Agreement, a violation of Hermes Casino’s Applicable Legislation, rules and or rights or of those of a Third Party, to any use of the Service and/or Software with the User’s login, whether it be with the User’s knowledge or without it, as well as any acceptance of profit on the User’s part.

10.2. If the User fails to adhere to any of these Terms and Conditions of this Agreement or if Hermes Casino reasonably suspect that the User is failing to comply with any of the provisions of this Agreement, Hermes Casino reserves the right, and all remedies at its disposition, and at its sole and absolute discretion, to block the User’s Account and any withdrawing of necessary amount from the User’s Account in order to compensate the damage suffered by Hermes Casino, or in exchange of any amount due to Hermes Casino, and until ruled upon it by a Court of Law.

10.3. If the User fails to abide to the Terms and Conditions of this agreement, Hermes Casino reserves the right to block the User’s Account, as well as indefinitely banning the User’s access to the Website, Service and Software belonging to Hermes Casino, and will have the right to initiate any legal proceeding against the User.

10.4. This Contract is effective immediately after clicking on « I agree » and remains valid until it is terminated in accordance to terms the conditions stated herein.

10.5. The User may terminate this Agreement at any time in writing to Hermes Casino by email under the condition that the User have no outstanding amounts with Hermes Casino, for any reason. The Termination of this Agreement becomes effective only after the User have received a notification in writing from Hermes Casino confirming the termination. From the moment when this contract becomes terminated, the User will no longer be authorized to use the Service and the Software, and the User is under the obligation to completely erase the Software from its computer and to destroy all documentation, related to the Service or to the Software, under the User’s possession, in the User’s power or under the User’s control.

10.6. Immediately following the termination of this Agreement, by either Party, Hermes Casino is bound to reimburse the integral amount indicated in the User’s Account, only after the deduction of any amount owed to Hermes Casino, if any.

10.7. The termination of this Agreement shall not prejudice any other right or engagement of either of the Parties in regards to any violation stated herein or any other violation.

10.8. All existing obligations between the Parties of this Agreement will be null and void after the termination of this Agreement, and for whatever reason, except if provided otherwise, under the reserved rights and obligations accepted prior to the termination.

 

11. Intellectual property

11.1.. In any event, it is strictly forbidden to copy, modify, tamper with, distribute, transmit, display, reproduce, transfer, upload, download or otherwise alter the Content of Hermes Casino’s Website.

12. Severability

If any provision contained in these Terms and Conditions shall be held by any court or other competent authority to be void or unenforceable in whole or in part, these Terms and Conditions shall continue to be valid as to the other provisions thereof and the remainder of the affected provision.

13. Entire agreement and admissibility 

13.1. Hermes Casino reserves the right to assign or otherwise lawfully transfer this Agreement. the User will not have the right to assign or otherwise transfer this Agreement without Hermes Casino prior written consent.

13.2. 13.3. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

14. Game rules

14.1. Once the User has finished playing a Game, the result of the respective Game cannot be changed nor cancelled. Hermes Casino retains the right to accept, not to accept or to partially accept games results. The provisions of this section are completed by the provisions of section 3, above.

14.2. End-User License

Save as expressly permitted by the Applicable Legislation, the User is strictly prohibited from, and agrees not to modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Software or any part of it or to create, publish or distribute derivative works from the Software. The User agrees that the Software will not be shipped, transferred or exported into any country or used in any manner prohibited by any Applicable Legislation, restrictions or regulations.

14.2.3. The User confirms that all information contained in the registration form submitted to Hermes Casino is true, accurate, and complete, and corresponds to the name(s) appearing on the credit cards used for the deposits and payments of gains. Hermes Casino reserves the right to terminate this Agreement in the event that the information provided to Hermes Casino was found to be false, inaccurate, deceitful or incomplete. 15. Applicable law
